TERMS OF USE

Terms of Use

These terms set out the conditions for using Futsal Board safely and responsibly.

Translation notice: This English version is provided for convenience. If there is any inconsistency, the Japanese version prevails.

Article 1 (Application)

These Terms of Use apply to the mobile application “Futsal Board” provided by Nobuhiro Takatsu (the “Operator”). You must agree to these Terms before using the App.

Article 2 (The App)

The App provides features for creating, saving, and sharing futsal tactics and player arrangements on a board. The Operator may separately specify available features, supported devices, and conditions of use.

Article 3 (Eligibility and equipment)

  1. You are responsible for providing the device, network connection, and other equipment needed to use the App.
  2. A minor must obtain consent from a parent or legal guardian before using the App.
  3. You must comply with applicable laws and the terms of the App Store or other distribution platform.

Article 4 (License)

Subject to these Terms, the Operator grants you a personal, non-exclusive, non-transferable, and non-sublicensable right to use the App. No ownership or intellectual property rights are transferred to you.

Article 5 (User-created data)

  1. Rights in boards, text, images, videos, and other data you create in the App remain with you or the applicable rights holder.
  2. You represent that you have the rights required for that data and that it does not infringe a third party’s rights.
  3. You are responsible for saving, backing up, sharing, and deleting your data. Data may be lost because of device failure, device replacement, or removal of the App.

Article 6 (Real-time sharing)

  1. Only connect to devices and networks you trust when using real-time sharing.
  2. Because edits made during sharing are reflected on participating devices, you are responsible for managing participants and shared content.
  3. Network conditions or device settings may cause disconnections, synchronization delays, or inconsistent data.

Article 7 (Prohibited conduct)

  • Violating laws, public order, or these Terms
  • Infringing the intellectual property, privacy, or other rights of the Operator or a third party
  • Unauthorized access, excessive load, or interference with the App or related systems
  • Copying, modifying, analyzing, decompiling, or reverse engineering the App beyond what applicable law permits
  • Redistributing, selling, lending, or sublicensing the App
  • Impersonation or use of the App for an improper purpose
  • Other conduct the Operator reasonably considers inappropriate

Article 8 (Intellectual property)

Intellectual property rights in the App and its software, design, text, images, trademarks, and other content belong to the Operator or their respective rights holders. Article 5 applies to user-created data.

Article 9 (Third-party services)

The App may use third-party services for analytics, diagnostics, distribution, or other purposes. Their own terms and privacy policies apply. Except where the Operator is at fault, the Operator is not liable for loss caused by a third-party service.

Article 10 (Changes, suspension, and termination)

  1. The Operator may change, temporarily suspend, or discontinue all or part of the App as necessary.
  2. Maintenance, failures, disasters, communication outages, or other unavoidable circumstances may result in suspension without prior notice.
  3. Where practicable, important changes or termination will be announced in the App or on this website.

Article 11 (Disclaimer of warranties)

The Operator does not expressly or implicitly warrant the App’s accuracy, completeness, usefulness, fitness for a particular purpose, continuity, security, freedom from defects, or protection against data loss. The App does not guarantee match results, sporting decisions, or safety.

Article 12 (Limitation of liability)

  1. Except in cases of intentional misconduct or gross negligence, the Operator is not liable for damage resulting from use or inability to use the App.
  2. Where applicable law imposes liability, it is limited—except in cases of intentional misconduct or gross negligence—to ordinary and direct damage actually incurred.
  3. This limitation does not apply where prohibited or restricted by applicable consumer or other laws.

Article 13 (Changes to these Terms)

The Operator may amend these Terms where reasonable in light of legal changes, necessity, and the appropriateness of the revised terms. Important changes will be announced in the App or on this page before they take effect. Continued use after a change constitutes acceptance of the revised Terms.

Article 14 (Governing law and jurisdiction)

These Terms are governed by Japanese law. Unless applicable law requires otherwise, the Japanese district court with jurisdiction over the Operator’s location has exclusive jurisdiction as the court of first instance for disputes concerning the App or these Terms.
